These Terms of Use (“Terms”) govern access to and use of heydoober.com, customer accounts, ordering tools, delivery services, communications, and related services offered by Doober (“Doober,” “we,” “us,” or “our”). By accessing the website, creating an account, or placing an order, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the website or services. Cannabis laws and local rules change, and our services are available only where and when Doober is legally authorized to operate.

1. ELIGIBILITY AND AGE REQUIREMENTS

Adult-use cannabis services are available only to customers who are at least 21 years old. A qualified medicinal patient who is at least 18 years old may be eligible where permitted by law and must provide a valid physician’s recommendation or other required documentation.

You must provide a valid, unexpired government-issued photo identification acceptable under applicable law. We may require age and identity verification when you create an account, place an order, and again at delivery. The person who placed the order must be present unless applicable law and Doober procedures expressly permit otherwise. We may refuse or cancel service when eligibility, identity, documentation, or legal authority cannot be verified.

2. CUSTOMER ACCOUNTS

You agree to provide accurate, current, and complete information, including your legal name, date of birth, delivery address, telephone number, email address, and any required eligibility information. You are responsible for keeping this information current.

You are responsible for maintaining the confidentiality of your username and password and for all activity occurring through your account. Do not share your account with another person. Notify us promptly at help@heydoober.com if you suspect unauthorized access or account misuse.

We may suspend or close an account when reasonably necessary to protect customers, prevent fraud, comply with law, investigate misuse, or enforce these Terms.

3. ORDERS AND PRODUCT AVAILABILITY

Submitting an order is a request to purchase and does not guarantee acceptance. All orders are subject to product availability, service-area restrictions, operating hours, purchase limits, identity verification, payment confirmation, and applicable law.

Product descriptions, photographs, potency information, ingredients, weights, and availability are provided for general information. Packaging and appearance may vary. If a product becomes unavailable, we may contact you to approve a substitution or remove the unavailable item. We will not substitute a materially different cannabis product without your consent.

We may reject, limit, or cancel an order that appears unlawful, fraudulent, inaccurate, duplicative, unsafe, outside our service area, or inconsistent with purchase limits or company policy.

4. PRICING, TAXES, FEES, AND PAYMENT

Prices, discounts, taxes, delivery charges, minimum-order requirements, and other fees will be presented before an order is finalized and may change before acceptance. If a displayed price is clearly incorrect, we may cancel the affected item or order and notify you.

Accepted payment methods may include cash and compliant on-site mobile ATM-style payment options. Minimal change may be available. Cash received by a driver is secured according to Doober’s cash-handling procedures. You agree to pay all charges shown in the confirmed order, including applicable taxes and fees.

Third-party payment providers may apply their own terms, privacy practices, transaction limits, or fees. Doober does not store full payment-card credentials unless expressly stated and lawfully supported by an authorized provider.

5. IDENTITY AND AGE VERIFICATION

A Doober representative must verify the recipient’s identity and eligibility before completing a regulated delivery. Acceptable identification may include a government-issued driver’s license or identification card, military photo identification, or passport, as permitted by law.

The name and identifying information must match the order and account information. A customer who cannot produce acceptable identification, appears to be presenting altered or borrowed identification, or fails another required verification may be denied delivery. Verification records may be maintained when required for regulatory, fraud-prevention, or transaction purposes.

For Recreational orders, You must be 21 years of age or older. Medical Patients, you must have a valid and current Doctor’s recommendation .

New Members may have to provide additional verification if required.

6. DELIVERY

Delivery is available only to addresses and jurisdictions served by Doober and legally eligible for cannabis delivery. You must provide accurate delivery instructions, a safe and lawful delivery location, and a working telephone number.

An eligible recipient must be present, responsive, and able to complete identity verification and payment. Drivers will not leave cannabis products unattended, in a mailbox, with a minor, or at an unapproved location. Drivers may refuse delivery when conditions appear unsafe, unlawful, threatening, or inconsistent with these Terms.

Quoted arrival times are estimates. Traffic, weather, product availability, verification requirements, order volume, safety concerns, and regulatory obligations may affect delivery time. Contact us promptly if your address or telephone number changes before delivery.

7. ORDER CHANGES, CANCELLATIONS, FAILED DELIVERIES, AND REFUNDS

Contact Doober as soon as possible to request an order change or cancellation. We cannot guarantee changes after an order has been prepared, assigned to a driver, or dispatched.

A cancellation fee, redelivery fee, or other disclosed charge may apply when a customer is unavailable, provides an incorrect address, cannot produce valid identification, refuses payment, or otherwise prevents a lawful delivery. We will communicate any applicable fee before charging it when required.

Cannabis products generally cannot be returned after delivery except where required by law, the product was damaged or incorrect, or Doober authorizes a return under its written policy. Do not use a product that appears damaged, opened, contaminated, mislabeled, recalled, or materially different from the order. Contact help@heydoober.com promptly with the order number and a description of the issue. Approved refunds will be issued through an available lawful method and may require reasonable verification.

8. PURCHASE LIMITS AND LAWFUL USE

You may not order or receive more than the amount permitted by applicable state or local law. Doober may combine transaction information and limit or refuse purchases when necessary to comply with daily limits or prevent unlawful diversion.

California State law allows Recreational customers to purchase up to a Maximum of 1 Ounce of flower or 8 grams of concentrates per day. Medical patients with a doctor’s recommendation can order up to 4 oz of flower and 16 grams of concentrates per day.

Cannabis purchased through Doober is for lawful personal use by the eligible customer. You may not resell, redistribute, export, ship, furnish to a minor, or otherwise divert cannabis products. You are responsible for knowing and following laws governing possession, storage, transportation, and consumption.

9. RESPONSIBLE USE AND HEALTH INFORMATION

Cannabis affects people differently. Product information on our website is educational and is not medical advice, diagnosis, or treatment. Statements about products have not necessarily been evaluated by the U.S. Food and Drug Administration. Consult a qualified healthcare professional regarding medical conditions, medications, pregnancy, nursing, impairment risks, or other health concerns.

Do not drive, operate machinery, or perform hazardous activities while impaired. Keep all cannabis products securely stored away from children and animals. Follow package warnings, serving information, and responsible-use guidance. In an emergency, call 911 or the appropriate poison-control resource.

10. PROHIBITED CONDUCT

You may not use the website, an account, or our services to violate law; misrepresent identity or eligibility; purchase for an ineligible person; resell or divert products; interfere with security or operations; access another customer’s account; introduce malicious code; scrape or copy protected content without permission; harass or threaten personnel; submit fraudulent payments or chargebacks; or abuse promotions, refunds, or loyalty programs.

We may investigate suspected violations and cooperate with regulators or law enforcement when required or permitted by law.

11. COMMUNICATIONS

By providing contact information, you authorize service-related communications about your account, orders, deliveries, safety notices, recalls, and support requests. Marketing email or text messages will be sent only as permitted by law and applicable consent. You may opt out of marketing communications using the instructions provided, but you may still receive necessary transactional or legal notices.

12. THIRD-PARTY SERVICES AND FUTURE POS INTEGRATIONS

Our website may link to or integrate with third-party services for website hosting, customer accounts, analytics, payment processing, menu display, inventory, ordering, delivery support, or other business functions. Future integrations may include Blaze or another point-of-sale provider.

Third-party services may be governed by separate terms and privacy policies. Doober is not responsible for an unaffiliated provider’s independent content, availability, security, or practices. An integration does not guarantee that every feature, price, product, or inventory count will be continuously accurate or available.

13. INTELLECTUAL PROPERTY

The Doober name, logo, website design, text, graphics, photographs, software, and other content are owned by or licensed to Doober and are protected by applicable intellectual-property laws. Subject to these Terms, Doober grants you a limited, personal, revocable, nonexclusive, nontransferable right to access the website for lawful personal use.

You may not copy, reproduce, modify, distribute, sell, license, create derivative works from, or commercially exploit protected content without written permission.

14. DISCLAIMERS

To the fullest extent permitted by law, the website and services are provided on an “as available” basis. We do not guarantee uninterrupted access, error-free operation, exact delivery times, continuous product availability, or that all third-party information will always be complete or current.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded. Product-specific rights, recalls, and remedies remain subject to applicable law.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Doober and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the website or services.

Where liability cannot be excluded, it will be limited to the greater of the amount paid for the transaction giving rise to the claim or the minimum amount required by law. These limitations do not apply where prohibited or to liability that cannot lawfully be limited.

16. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Doober and its owners, officers, employees, and contractors from claims, losses, liabilities, costs, and reasonable attorneys’ fees arising from your unlawful conduct, misuse of the services, violation of these Terms, or infringement of another person’s rights.

17. DISPUTES AND CALIFORNIA LAW

Before filing a formal claim, you agree to contact help@heydoober.com and give us a reasonable opportunity to address the issue. These Terms are governed by California law, without regard to conflict-of-law principles.

Any dispute not resolved informally will be brought in a court of competent jurisdiction located in Sacramento County, California, unless applicable consumer law requires another venue. Nothing in these Terms prevents either party from seeking relief in small claims court when eligible or from pursuing rights that cannot be waived.

18. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our services, vendors, policies, or legal obligations. The revised Terms will be posted with a new “Last Updated” date. Material changes will receive additional notice when required by law. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.

19. SEVERABILITY AND ENTIRE AGREEMENT

If any provision is found unenforceable, the remaining provisions will remain in effect, and the affected provision will be interpreted as closely as legally permitted to its intended purpose. These Terms, together with the Privacy Policy and any order-specific disclosures, form the agreement between you and Doober concerning the website and services.
